U.S. Fails In Extradition Bid, Decides Against Appeal

Malcolm Hawkes In Double-Jeopardy Extradition Win

As reported by WireNews+Co last week, the United States of America failed in its attempt to extradite, to New Hampshire, an American citizen sought in connection with obtaining a false passport in 1997.

In February 2013 the requested person was arrested in the United Kingdom after the United States had accused him of the offence of applying for the renewal of the passport.

But in June 2013 the Senior District Judge at Westminster Magistrates’ Court in the City of London discharged the U.S. extradition request on the grounds of double-jeopardy.

Malcolm Hawkes represented the requested person, who had already been convicted in 2010 in the UK for the offences of possession and use of the false U.S. passport.

The U.S. Department of Justice had been given until 4:30pm today to appeal the Court’s ruling, but decided against taking the case further.
