Les "Race studies", en Amérique du Nord, visent à analyser la construction sociale et idéologique de la "race", qui aboutit à produire des effets réels d’auto-identification et de reconnaissance en termes d’appartenance à telle ou telle "race". Le droit n’y est pas étranger : ainsi, la "race" est incluse comme paramètre dans le recensement aux Etats-Unis, bien qu’elle soit facultative. En outre, la Cour suprême des Etats-Unis a eu maintes fois l’occasion de statuer sur la "race" - United States v. Bhagat Singh Thind en 1923, lois sur la déségrégation scolaire, lois sur l’affirmative action, etc.).
